These Terms and Conditions (“Terms”) govern your access to and use of the website, services, products, events, bookings, and offerings (“Services”) provided by Dolce Social Club, a DBA of The Fancy Group LLC (“Dolce Social Club,” “we,” “us,” or “our”). By accessing, browsing, using the Site, or booking our Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Site or Services.

1. Acceptance of Terms

By accessing, browsing, using the Site, or booking our Services, you acknowledge and agree to these Terms and theDolce Social Club Catering Contract (link provided upon booking). If you do not agree, do not use the Site or Services.

2. Eligibility

You must be at least 18 years old and have full legal capacity to enter into a binding agreement to use our Services. By accessing our Services, you represent and warrant that you meet these requirements.

3. Modifications

We may modify these Terms at any time by posting updated Terms on the Site. Updated Terms become effective when posted. Continued use of the Services after revisions constitutes acceptance of the updated Terms.

4. Services and Booking

Dolce Social Club provides event planning, dessert catering, social experiences, and related Services.

When you book a Service:

  • You agree to provide accurate contact, billing, and event information.

  • You agree to timely payment of all fees.

  • Your booking is subject to availability and acceptance by us.

We reserve the right to refuse or cancel bookings for any reason, including suspected fraud, pricing errors, or safety concerns.

5. Payments and Fees

  • You agree to pay all applicable fees, taxes, and charges associated with your booking or purchase (“Fees”).

  • Payments may be collected via third-party processors.

  • All Fees are due at time of booking unless otherwise stated.

  • Prices are subject to change without notice.

  • Failure to pay may result in cancellation of Services.

6. User Conduct

You agree:

  • Not to use the Site or Services for unlawful or prohibited purposes.

  • Not to post defamatory, abusive, or obscene content.

  • Not to interfere with any third party’s use of the Services.

  • To comply with applicable local, state, and federal laws.

Violation may result in suspension or termination of your access and legal action.

7. Intellectual Property

All content on the Site, including text, graphics, logos, images, software, and trademarks (“Content”), is the property of Dolce Social Club, a DBA of The Fancy Group LLC, or its licensors.

You may use the Content only as expressly permitted. Unauthorized use is prohibited.

8. Privacy and Data

Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect your personal information. By using the Services, you consent to our privacy practices as outlined in the Privacy Policy.

THE SERVICES AND CONTENT ARE PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Dolce Social Club, a DBA of The Fancy Group LLC does not guarantee that the Site will be uninterrupted, error-free, or secure.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE FANCY GROUP LLC, INCLUDING ITS DBA DOLCE SOCIAL CLUB, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability for any claim arising under these Terms shall not exceed the amount paid by you for the Servicesgiving rise to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless The Fancy Group LLC, including its DBA Dolce Social Club, and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising out of or in any way connected with:

  • Your use of the Services;

  • Your breach of these Terms;

  • Your violation of applicable law or rights of a third party.

13. Media Release and Use of Likeness

Client grants Dolce Social Club, a DBA of The Fancy Group LLC, its owners, employees, contractors, and representatives, the irrevocable, perpetual, worldwide, royalty-free right and permission to photograph, video record, and otherwise capture images, audio, and visual content at any event or in connection with the Services.

Client further grants Dolce Social Club the unrestricted right to use, reproduce, publish, display, distribute, and create derivative works from such content for marketing, advertising, promotional, social media, website, portfolio, and other business purposes, in any media format now known or hereafter developed, without further notice, approval, or compensation.

Client represents and warrants that they have obtained or will obtain any necessary permissions from event attendees, guests, or participants for such photography and videography, and for the use of their likenesses as described herein.

To the fullest extent permitted by law, Client waives, releases, and discharges Dolce Social Club and The Fancy Group LLC from any and all claims, demands, or causes of action arising out of or related to the use of such images or recordings, including but not limited to claims for invasion of privacy, right of publicity, defamation, or emotional distress.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Texas and the United States. You agree that any disputes arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Texas.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be struck and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy and any booking or service confirmations, constitute the entire agreement between you and The Fancy Group LLC, including its DBA Dolce Social Club, regarding the subject matter.
