DOLCE SOCIAL CLUB - CONTRACT OF SERVICES

Effective Date: Upon payment of deposit or full amount

This Contract for Services (“Agreement”) is made between Dolce Social Club, a DBA of The Fancy Group LLC, a Texas limited liability company (“Dolce Social Club”), and the client identified in the invoice or email (“Client”).

By paying a deposit or full payment for services, Client acknowledges that they have read, understood, and agree to be bound by this Agreement.

1. Services

Dolce Social Club shall provide catering and event services (“Services”) as specified in the invoice or booking confirmation.

  • Services are generally self-serve / buffet style, unless otherwise agreed.

  • Staffing will be provided in a manner consistent with the experience required for the booking.

  • Client is responsible for providing any additional equipment or supplies not listed in the invoice.

2. Fees and Payment

  • Total fees are listed in the invoice.

  • Deposit: 50% of total fees, unless full payment is required due to timing or corporate/commercial bookings.

  • Final Payment: Due 30 days prior to the Event unless otherwise stated.

  • Accepted payments: major credit cards, ACH, or as specified in the invoice.

Payment of the deposit or full payment constitutes acceptance of this Agreement and all its terms.

3. Cancellation and Rescheduling

  • Deposits are non-refundable.

  • Dates may be rescheduled subject to availability.

    • If rescheduling requires additional staffing or resources, a 25% surcharge may apply.

4. Force Majeure

Neither party shall be liable for failure or delay in performing obligations due to events beyond reasonable control, including natural disasters, government orders, public health emergencies, fire, or acts of God.

5. Use of Event Images

Dolce Social Club retains the right to use photographs or videos from the Event on social media and its business website for marketing purposes. Use in other advertising mediums requires separate permission.

6. Allergen Disclaimer

Dolce Social Club is not an allergen-free kitchen. Clients are responsible for notifying guests of potential allergens and taking precautions.

7. Indemnification / Assumption of Risk / Limitation of Liability

  • Client shall indemnify, defend, and hold harmless Dolce Social Club, its officers, directors, employees, agents, and affiliates from all claims, losses, liabilities, damages, or expenses (including attorney fees) arising from:

    • Acts or omissions of Client, its agents, employees, contractors, or invitees

    • Personal injury, property damage, or death in connection with the Event

  • Client assumes all risk of injury to guests or invitees.

Exceptions: Indemnification and assumption of risk do not apply to gross negligence or intentional misconduct by Dolce Social Club.

Limitation of Liability:

  • Neither party shall be liable for indirect, incidental, consequential, special, or exemplary damages.

  • Total liability for any claim shall not exceed the amount paid by Client under this Agreement.

8. Governing Law / Venue

This Agreement is governed by the laws of the State of Texas and the United States. Any disputes shall be resolved exclusively in state or federal courts located in Texas.

9. Entire Agreement / Amendments

This Agreement, together with the invoice/booking confirmation and Cancellation & Booking Policy, constitutes the entire agreement between Client and Dolce Social Club.

Amendments must be in writing and agreed to by both parties.

10. Acceptance via Payment

By paying a deposit or full payment, Client acknowledges that:

  • They have received and read this Agreement

  • They agree to all terms, including liability, cancellation, rescheduling, and policies

  • This Agreement is legally binding without a separate signed copy

11. Media Release and Use of Likeness

Client grants Dolce Social Club, a DBA of The Fancy Group LLC, its owners, employees, contractors, and representatives, the irrevocable, perpetual, worldwide, royalty-free right and permission to photograph, video record, and otherwise capture images, audio, and visual content at any event or in connection with the Services.

Client further grants Dolce Social Club the unrestricted right to use, reproduce, publish, display, distribute, and create derivative works from such content for marketing, advertising, promotional, social media, website, portfolio, and other business purposes, in any media format now known or hereafter developed, without further notice, approval, or compensation.

Client represents and warrants that they have obtained or will obtain any necessary permissions from event attendees, guests, or participants for such photography and videography, and for the use of their likenesses as described herein.

To the fullest extent permitted by law, Client waives, releases, and discharges Dolce Social Club and The Fancy Group LLC from any and all claims, demands, or causes of action arising out of or related to the use of such images or recordings, including but not limited to claims for invasion of privacy, right of publicity, defamation, or emotional distress.
